All models, actors, actresses and other persons who appear in any visual depiction of actual or simulated sexually explicit conduct appearing on, or otherwise contained in, this website were over the age of eighteen years at the time the visual depiction was created.
HerFans is an online platform. The content on it is uploaded by independent creators who hold accounts here, and it is those creators who produce the material and who are the primary producers of it within the meaning of 18 U.S.C. 2257 and 28 C.F.R. Part 75. HerFans acts as a secondary producer and as the operator of the service.
Some of the material on this site is not covered by 2257 at all, either because it contains no depiction of actual or simulated sexually explicit conduct or because it was produced before the effective dates set out in 28 C.F.R. 75.7(c). This statement applies to the material that is covered.
No account on HerFans can publish content until the person behind it has been verified. Before a creator account is approved for publishing we require, and keep on file:
Where anyone other than the account holder appears in a depiction, we verify that person ourselves before the content is published. The creator invites them from her account. They open an account of their own, which has no public page and cannot publish, and go through the same identity check as a creator: a government-issued photo identity document showing their legal name and date of birth, and a liveness check. They then read and sign a participant consent and release themselves, either for all material they make with that creator or for named pieces, and we record the date and time, the internet address and browser it was signed from, and the version of the text. Every alias that person has used is recorded with the depiction.
Content in which another person appears is held, and not published, until every person in it has a verified identity, is at least 18 years old by their document, and has signed. A person who appears in content can withdraw their consent from their own account at any time: the material with them in it comes down, and the record that they consented and later withdrew is kept. Consent records that a creator uploaded on another person's behalf before this procedure existed remain on file and remain valid, and we invite those people to confirm them in their own account. Content submitted without those records is held and not published. Publishing content in which another identifiable person appears without a release on file is a violation of our prohibited content policy and ends the account.
Identity documents, dates of birth, alias lists and consent records are held in encrypted storage, separately from public profile data, and are accessible only to the small number of people who need them for verification, compliance and legal response. They are never shown to other users, never attached to a public profile, and never used for marketing. We keep them for as long as the content is published and for the period afterwards required by law. They are not deleted automatically when an account closes, and they are encrypted on our server's disk. See our Privacy Policy for the full treatment of verification data.
The records required by 18 U.S.C. 2257 and 28 C.F.R. Part 75 for material appearing on this site are kept by a custodian of records, and are available for inspection as provided by law.

This site is operated by a company registered in Poland. Its registered name, registration number, registered address and tax identification are set out in our Legal Notice.
If you believe that anyone depicted on HerFans was under 18 at the time the content was made, or that any material here is published without the consent of a person appearing in it, tell us immediately through the complaints form. You do not need an account to use it. Reports of that kind are treated as urgent: the material is taken out of circulation while we investigate, not after, and we report to the authorities where the law requires it.

Adults only, 18 or over
HerFans is a subscription platform for adult creators and is restricted to people aged 18 or over, or the age of majority where you live if that is higher. Nothing explicit is shown on these public pages: adult material is behind sign-up and is visible only to members who have confirmed their age. By continuing you confirm you meet that age, that adult material is legal where you are, and that you accept our Terms and Privacy Policy. Parents can restrict access with tools such as ASACP-listed filtering software.
